(hereinafter referred to as the Provider).
INTRODUCTION
All information presented on the websites managed by the Provider www.fitnessmama.co, and the educational platform www.gc.fitnessmama.co is the exclusive property of INNKO LLC (hereinafter referred to as the Provider), and is intended for the Provider's clients or beneficiaries (hereinafter referred to as the Beneficiary).
This section, entitled "Terms and Conditions of Use", regulates the manner of using and applying for the online body reshaping program (hereinafter referred to as the Services), provided and facilitated by the Provider through the platform www.fitnessmama.school (hereinafter referred to as the Platform).
LEGAL TERMS
By contracting the Services and/or enrolling in the online body reshaping program provided by the Provider, you expressly accept and agree to comply with the following Terms and Conditions of Use (hereinafter referred to as the Terms and Conditions).
The Terms and Conditions, together with any forms required for applying to the Services, constitute the agreement/contract between the Provider and the Beneficiary, under which you obtain the right to temporarily use an account associated with the Services on the Platform (personal account).
The temporary right to use the account is granted only after the corresponding Service fee has been paid.
For this reason, we kindly request that you carefully read the Terms and Conditions presented on the website. If you have any questions, do not hesitate to contact us.
If you do not agree with the Terms and Conditions, this constitutes a refusal to enter into a contract with the Provider, and consequently, you will not be able to purchase and/or benefit from the Provider's Services.
The Provider reserves the right to update and modify the Terms and Conditions without prior notice. Continued use of the Service after such modifications constitutes the Beneficiary's acceptance of those changes.
Violation of the Terms and Conditions will result in the termination of Services and the closure of the Beneficiary's account (personal cabinet) on the Platform.
DESCRIPTION AND USE OF SERVICES
The Provider facilitates the Beneficiary's access to the online body reshaping program, consisting of video lessons and personalized nutrition recommendations.
The Services are produced and delivered at a high level of professionalism, created by specialists in the field.
However, to avoid any misunderstanding, the Provider cannot, under any circumstances, be held responsible for the results obtained or expected as a result of purchasing the Services.
To purchase the Services and access the Platform, the following steps must be taken:
a) Review the information presented on www.fitnessmama.co or www.gc.fitnessmama.co;
b) Review the available Service packages and select the one you wish to purchase;
c) Accept these Terms and Conditions;
d) Complete the Application Form for participation in the body reshaping program (hereinafter – the Form);
e) Follow the instructions sent to your email address provided in the Form;
f) Choose one of the payment methods available on the Platform;
g) After payment, you will receive at the provided email address a confirmation of purchase and your login credentials (username and password) for your personal account on the Platform.
The Services are accessible to any person over the age of 18 who has paid the full service fee.
As the Beneficiary, you are solely responsible for the accuracy and correctness of the data provided in the Form, confirming that you are at least 18 years old, possess full legal capacity, and understand your rights and obligations in relation to the Provider.
Therefore, the Provider cannot be held responsible for any misrepresentation or inaccuracy in this regard.
When completing the Form (placing the order), as a potential Beneficiary, you must provide complete, accurate, and up-to-date personal data, including but not limited to: full name, email address, and phone number for contract validation.
Throughout the use of the Service, the Beneficiary is solely responsible for activities carried out in or related to their personal account. Each Service is provided intuitu personae (personally), each user account being unique. Thus, the Beneficiary may not transfer, in whole or in part, any contractual rights or obligations to any third party.
The Beneficiary must not disclose their login credentials (username and password) and must ensure their confidentiality and security.
The Beneficiary must immediately notify the Provider of any unauthorized use or potential exposure of login credentials to third parties.
Failure to comply with these obligations will render the Beneficiary liable for any damages caused to the Provider.
Note:
Access to the personal account (after payment) does not automatically mean instant access to the entire body reshaping program.
Within a maximum of 7 days from the payment date, the Beneficiary will receive personalized nutrition recommendations in their account.
Since the program content is divided into Lessons, access to these lessons will be provided gradually according to the schedule published on www.fitnessmama.co or www.gc.fitnessmama.co at the time of purchase.
PERSONAL DATA AND SECURITY POLICY
The Provider collects, processes, and/or uses the information you provide for the purpose of delivering the Service.
Completing the forms on the site constitutes unconditional acceptance that your data will be stored in the Provider's database and processed by the Provider, its affiliates, and partners for the purposes mentioned above, including but not limited to marketing, payment, and banking service providers.
Processing purposes include:
* Providing interactive online training courses to individuals seeking to acquire new skills;
* Offering training to entrepreneurs and managers seeking professional improvement;
* Enrolling and facilitating client participation in training programs;
* Identity verification and management of contractual relationships;
* Creating the client's personal account on the Platform;
* Issuing certificates upon completion of training programs;
* Managing clients and contracted services;
* Providing customer support and responding to inquiries.
The following personal data categories will be processed:
Full name, mobile phone number, email address, telephone/fax number.
Through cookies, the following information will be collected:
Anonymized IP address, date and time of access, page name, session ID, referrer URL, data transferred, browser and version details, and the operating system used.
The Beneficiary consents that the Provider may share their personal data with its partners for the performance of the contract, including but not limited to SMS or email communication and phone calls.
In accordance with personal data protection laws, the Provider guarantees the maximum protection of the Beneficiary's personal data against destruction, alteration, copying, dissemination, or other unlawful actions.
The Provider processes personal data securely and solely for the specified purposes.
The Beneficiary enjoys the rights provided by data protection laws, including:
the right to information, the right of access, the right to rectification, the right to object, the right not to be subject to automated decisions, and the right to legal remedy in case of rights violation.
The Beneficiary may request the full or partial deletion of their personal data, as well as the deactivation (deletion) of their user account, by submitting a written request to support@fitnessmama.co.
Refusal to provide these data makes it impossible for the Provider to deliver the Service.
The Provider employs security tools, techniques, and internal employee policies to protect your personal data, whether directly or indirectly identifiable.
COPYRIGHT AND CONTENT OWNERSHIP
All content of www.fitnessmama.co and www.gc.fitnessmama.co, including but not limited to:
logos, texts, software, sounds, presentations, video/audio files, tests, articles, graphics, tools, databases, know-how, translations, or any part of the body reshaping program, is the exclusive property of the Provider and protected by copyright law.
The Beneficiary has the right to use the Services only in compliance with copyright laws and these Terms and Conditions.
The Beneficiary expressly declares that they will NOT:
(a) publish, reproduce, or distribute any part of the content, directly or indirectly;
(b) use the Services or site content for anything other than personal purposes;
(c) allow third parties to access their account;
(d) disable or bypass security features;
(e) remove or hide copyright or ownership notices.
Violation of these provisions may result in:
(a) liability for damages caused to the Provider;
(b) permanent loss of access to the Platform and purchased Services, without refund or compensation.
The Beneficiary must immediately inform the Provider of any suspected infringement of the Provider's intellectual property rights.
PAYMENT OF SERVICES
Services ordered via the Form are paid, and their prices are clearly displayed on www.fitnessmama.co or www.gc.fitnessmama.co.
Prices are fixed and non-negotiable. By ordering, the Beneficiary irrevocably accepts the displayed price.
After submitting the order, the Beneficiary will receive an order confirmation, invoice, and payment instructions via email.
Payments can be made via the methods listed on the websites — in cash at the Provider's headquarters, by valid debit/credit card, bank transfer, terminal payment, or financing options.
After payment, within 48 hours, the Beneficiary will receive confirmation and login credentials for the Platform.
Once access is granted, the sale is considered final and the amount non-refundable, except as stated in these Terms.
All Provider's Services are delivered on a subscription basis with automatic payments.
This means that upon making the first payment, the Beneficiary activates a periodic subscription, and every 30 / 60 / 90 / 360 / 720 days (depending on the package), their card will be automatically charged.
To cancel recurring payments, the Beneficiary must follow the steps in the "Cancellation of Services" section.
CANCELLATION OF SERVICES
The Beneficiary may request a full refund only if the Service has not yet started (i.e., the personal account has not been activated), or within 3 calendar days from the moment access was granted.
To cancel a monthly/quarterly/annual subscription, the Beneficiary must send a written cancellation request to support@fitnessmama.co.
All payments withdrawn after this email will be refunded by the Provider.
At the end of the program, the Provider may, at its discretion, issue a certificate of successful completion.
DURATION OF SERVICE ACCESS
From the moment of payment and account activation, the Beneficiary has access to all materials included in the purchased program.
Access duration depends on the selected package and usually equals the program's actual duration plus 10 calendar days.
Each program's access period and service scope are specified in the product description on www.fitnessmama.co or www.gc.fitnessmama.co.
SERVICE WARRANTY
The Services are developed and delivered professionally. However, the Provider offers no guarantee of specific results, physical changes, or outcomes.
All information provided through www.fitnessmama.co, www.gc.fitnessmama.co, and www.fitnessmama.school is for informational purposes only and does not replace medical advice, diagnosis, or treatment.
The Provider recommends that Beneficiaries consult a doctor before beginning the program.
If at any point the Beneficiary experiences pain or health issues, they must:
(a) immediately notify the Provider;
(b) suspend nutrition recommendations;
(c) stop performing exercises;
(d) contact a medical professional immediately.
Note:
The Provider bears no responsibility for the deterioration of the Beneficiary's health related to the use of the Services.
The Beneficiary is solely responsible for their health condition and for their ability to use the Services properly.
FINAL PROVISIONS
Acceptance of these Terms constitutes a legally binding service agreement between the Beneficiary and the Provider.
The Provider may send notifications, updates, or promotional materials to the email address provided in the Form, as deemed appropriate.
The Provider reserves the right to modify or remove any information within these Commercial and Confidentiality Terms at its discretion.
The latest version of these Terms will always be available at the same web address, along with the date of the last modification.
If you encounter any irregularities related to Platform access or functionality, you have the right to notify the Provider using the contact information available on https://fitnessmama.co.
These Commercial and Confidentiality Terms are governed by the applicable legislation in force.
Any rights not expressly provided herein remain subject to the relevant laws in force.
